Elliott had his six-game suspension reinstated on Monday and filed an appeal the following day.
The Second Circuit was briefed on Elliott's emergency motion on Thursday and did not schedule a court date this week, though they could make a decision on the case based on paperwork alone, according to gaming and sports attorney Daniel Wallach.
Elliott's team and the players association started the process of filing their latest motion on Wednesday. It is expected to be Elliott's last real shot at playing this week, according to Kate Hairopoulos of The Dallas Morning News.
