Dayton's Dyshawn Pierre will fight suspension for assault allegation

Dayton forward Dyshawn Pierre will fight his 10-game school-issued suspension.

In May, a sexual assault was reported in Montgomery County, Ohio, which linked to Pierre's name, though charges were never pressed due to insufficient evidence.

Dayton announced Sunday that Pierre is suspended for the fall semester, but according to his lawyer, Peter R. Ginsberg, Pierre will fight the suspension.

"A false accusation against University of Dayton student-athlete Dyshawn Pierre has recently become the subject of media attention in light of Dyshawn's semester-long suspension," Ginsberg said. "Dyshawn adamantly denies that he engaged in any inappropriate conduct of any sort. Law enforcement clearly agreed and decided not to pursue prosecution of him. Ignoring that decision made by qualified professionals, the University of Dayton subjected Dyshawn to fundamentally defective and unfair University disciplinary procedures orchestrated to appease a broken Department of Education policy. We will be challenging the University's handling of this matter in the near future."

If the suspension doesn't get revoked, Pierre will be eligible to return to the team Dec. 22 when the Flyers take on Miami (Ohio).

Pierre is the leading returning scorer and rebounder, averaging 12.7 points and grabbing 8.1 boards per game last season.
