Tiger, girlfriend sued for wrongful death after employee's drunk-driving accident

Tiger Woods is being sued for the death of a former restaurant employee who was involved in a drunk-driving accident in December 2018, according to Golf.com's Kevin Cunningham, citing a complaint filed in Palm Beach County on Monday.

His girlfriend, Erica Herman, is the general manager of The Woods Jupiter restaurant and is also named in the lawsuit.

Nicholas Immesberger crashed his vehicle after spending the night of Dec. 10 drinking at Woods' restaurant. He was found with a blood alcohol concentration more than three times the legal limit.

"We're all very sad that Nick passed away," Tiger said at his PGA Championship press conference Tuesday. "It was a terrible night, a terrible ending, and we feel bad for him and his entire family. It's very sad."

The lawsuit states "the employees and management at The Woods continued to serve Immesberger alcohol to the point of intoxication knowing that he had driven to work and had no other way home." It also states that Woods, Herman, and other employees were aware that Immesberger had a drinking problem but still overserved him regularly.

The lawyers for the Immesberger family allege The Woods Jupiter has destroyed video evidence of the employee drinking at the bar for three hours, according to ESPN.

"One of the most significant issues we have here is the destruction of evidence," attorney Spencer Kuvin said Tuesday. "Obviously it shows that somebody knew something had gone wrong and they wanted to get rid of that evidence. We have evidence to show that that videotape, showing Nick at the bar that night after he got off at 3 p.m., drinking for three hours at the bar, was destroyed shortly after the crash had occurred."

According to the lawsuit, Herman and other employees were aware that Immesberger was in another accident one month prior to the fatal crash after being served at The Woods.

The lawsuit seeks damages in excess of $15,000.
