Dyshawn Pierre suing Dayton following suspension

Suspended Dayton forward Dyshawn Pierre is suing his school for what his lawyer, Peter R. Ginsberg, called "a fundamentally unfair and defective internal process that deprived him of vital rights."

Pierre was suspended after his name was linked to a sexual assault case in April, but charges were never pressed due to insufficient evidence.

In September, Dayton announced Pierre would be suspended for the fall semester, but the senior has since tried to fight the penalty.

"This university’s decision, unsupported by any objective or credible evidence of any sort, flies in the face of law enforcement’s determinations about the charge of sexual assault," Ginsberg said.

Pierre is looking for permission to re-enroll, and to be eligible to play for the Flyers again.

"What has been done to me has been grossly unfair. The allegations against me are false. And now, I find myself with my reputation tarnished, my schooling interrupted and my dream of helping the basketball team win a national championship being threatened. I want justice and I want a return to my normal life," Pierre said.
