Former New Orleans Saints defensive end Will Smith's blood alcohol level was three times the legal limit on the night he was shot dead, sources told The Times-Picayune.

Toxicology reports listed Smith's blood alcohol content at 0.24, three times more than Louisiana's legal limit of 0.08, per the sources.

Smith was killed on April 9, shortly after his vehicle collided with one driven by Cardell Hayes, a former New Orleans high school star. Hayes has been indicted on a second-degree murder charge.

Peter Thomson, Smith's attorney, previously stated his client was not inebriated to a level of being incapable of driving.

On the night he was killed, Smith went out to dinner with his wife, Racquel, and former Saints teammate Pierre Thomas, among others.
