Encarnacion files motion to dismiss STD lawsuit

Edwin Encarnacion has filed a motion in New York court to dismiss the $11.5-million lawsuit brought against him in August by a 24-year-old woman who claims he knowingly infected her with genital herpes and chlamydia.

Ashley Lebron, a family friend who grew up across the street from Encarnacion's aunt in the Dominican Republic, sued the veteran Toronto Blue Jays star and impending free agent for battery and misrepresentation of the facts for knowingly giving her the STDs during a February hookup in Punta Cana.

On Tuesday, Encarnacion's lawyers asked for the claim to be thrown out, arguing there's no evidence he was the one who infected her (let alone, that he did so knowingly), and that New York isn't the appropriate jurisdiction for her claim.

"The complaint is devoid of a single fact supporting her conclusory allegations that the defendant knew or should have known that he had herpes and/or chlamydia," the motion reads, per Brendan Kennedy of the Toronto Star.

Lebron's original suit claims she suffered "psychological and economic injuries and damage" following her encounter with Encarnacion that have caused her to "endure great pain and suffering."
