Girlfriend drops assault complaint against Phillies' Herrera, case dismissed

Assault charges against Philadelphia Phillies outfielder Odubel Herrera have been dismissed, according to Meghan Montemurro of The Athletic.

Herrera appeared in a New Jersey court on Wednesday, where the judge dismissed his case. The state is not able to move forward with the charges because the plaintiff - his girlfriend - elected not to pursue them.

The 27-year-old Herrera was arrested in May after a domestic violence incident at the Golden Nugget Hotel and Casino in Atlantic City. His girlfriend had "visible signs of injury to her arms and neck that was sustained after being assaulted by her boyfriend, David Odubel Herrera, during a dispute," according to the police statement.

Herrera remains away from the Phillies on administrative leave. Though the charges have been dropped, he could still be given a suspension under the MLB-MLBPA Joint Domestic Violence, Sexual Assault, and Child Abuse Policy. Meanwhile, no date has been specified for a return to the team.

The former All-Star has appeared in 39 games this season and is under contract through 2021 with team options for both 2022 and 2023.
