Manchester City striker Sergio Aguero is considering whether to press charges for common assault against a Wigan Athletic supporter whom the Argentine claims spat in his ear, the Guardian's Jamie Jackson reports.

Aguero also believes the fan told him to "suck my dick" amid a pitch invasion at the DW Stadium.

The incident occurred as Aguero and his City teammates - beaten 1-0 by Wigan in a shocking FA Cup result - were walking off the field. Footage shows a man in a green jacket approach the City poacher. An enraged Aguero then appeared to make contact with the fan before being restrained by Wigan defender Chey Dunkley:

City complained that the stewarding at Wigan was inadequate for a fifth-round FA Cup tie, according to Jackson. The Premier League leader's own fans were seen ripping up and throwing advertisement boards behind one of the goals.

The Football Association, however, won't take any disciplinary action against Aguero. Goal correspondent Sam Lee reports that the player is "in the clear," but there's no word yet on whether the FA will punish Wigan.

The third-tier side announced its own an investigation into the crowd trouble earlier Tuesday.

"While we appreciate that the vast majority of supporters who ran on to the pitch did so spontaneously to celebrate a famous victory, we were disappointed with the action of a minority of supporters who acted in an inappropriate manner," Wigan executive Jonathan Jackson said.

"Player and staff safety is of paramount importance and we will conduct a full investigation."
