Tom Brady filing appeal to have suspension case reheard

The attorneys for New England Patriots quarterback Tom Brady confirmed to ABC News on Monday that they will file an appeal to have his suspension case reheard in the U.S. 2nd Circuit Court of Appeals.

Brady's four-game suspension, initially imposed as a result of the NFL's "Deflategate" investigation, was reinstated by a three-person appeals panel in April.

The "en banc" hearing Brady's representation is now pushing for would involve the entire 2nd Circuit bench.

"The facts here are so drastic, and so apparent, that the court should rehear it," said Brady's lawyer, former solicitor general Ted Olson.

Brady and the NFLPA will make the petition official Monday. What remains unclear, though, is whether the court will agree to a rehearing.

A denial would likely see the quarterback's lawyers attempt to take the matter to the U.S. Supreme Court.
