Former Los Angeles Clippers owner Donald Sterling refuses to go away quietly.

Donald is appealing the probate court's decision to award control of the Sterling family trust to his estranged wife Shelly last summer, ESPN's Ramona Shelburne reports. That decision allowed Shelly to sell the Clippers to Steve Ballmer for roughly $2 billion.

Shelly took over control of the Sterling family trust after two neurologists separately ruled Donald as incapacitated. The case was spun into a lengthy battle before the probate court, which allowed Shelly to continue with the deal.

Donald was caught making racist remarks in a secretly taped conversation last summer, which ultimately led to his removal from the NBA.

The court of appeals have set Donald's hearing for Oct. 28. Donald is also suing the NBA and divorcing his wife, Shelburne adds.
